DENIAL OF INSURANCE COVERAGE
- A major health insurance company collected premiums from a husband and wife. When the wife developed serious heart problems, the insurance company denied coverage alleging she had failed to disclose a pre-existing condition. After suit, the Court rejected such an argument and all of the client's medical bills, in excess of $100,000, were paid by the insurance company.
- A widow tried to collect the proceeds on two life insurance policies taken out by her deceased husband. The life insurance company denied payment on both policies after telling the widow they believed her deceased husband had made certain misrepresentations on his insurance application forms. Bill was retained by the widow and obtained copies of various medical records and the relevant life insurance documents. After threatening a lawsuit against the insurance company, the company paid the widow the full amount of both policy limits without necessity of a lawsuit.
